1. Acceptance of Terms
By creating an account or otherwise accessing EbbiWriter (the "Service"), you confirm that you are at least 16 years of age and that you accept and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must not use the Service.
2. Description of Service
EbbiWriter is a cloud-based writing and manuscript management platform that allows users to draft, organise, and export written works. The Service is provided on an "as is" and "as available" basis. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice where required by applicable law.
3. User Accounts and Registration
You must register for an account to access certain features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to keep that information up to date. You must notify us immediately of any unauthorised use of your account.
4. Acceptable Use
You agree not to use the Service to upload, transmit, or distribute any content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable. You may not attempt to gain unauthorised access to any part of the Service, interfere with its operation, or circumvent any security measures. We reserve the right to suspend or terminate accounts that violate these conditions.
5. Intellectual Property Rights
All content you create and store within the Service remains your intellectual property. By using the Service, you grant EbbiWriter a limited, non-exclusive licence to host and process your content solely for the purpose of providing the Service to you. EbbiWriter retains all rights to its own software, branding, and platform technology. You may not copy, modify, or distribute any part of the platform without our prior written consent.
6. Subscriptions and Payment
Certain features of the Service require a paid subscription. Subscription fees are charged in advance on a monthly or annual basis and are non-refundable except where required by applicable EU consumer law. You may cancel your subscription at any time; access to paid features will continue until the end of the current billing period. All prices are inclusive of applicable value-added tax (VAT) where required by EU law.
7. Cancellation and Termination
You may delete your account at any time via your account settings. Upon deletion, your data will be removed in accordance with our Privacy Policy and applicable data retention obligations. We reserve the right to suspend or terminate your account if you breach these Terms, subject to providing you with reasonable prior notice and an opportunity to remedy the breach where required by law.
8. Data Protection and GDPR
EbbiWriter processes your personal data in accordance with the EU General Data Protection Regulation (GDPR) and our Privacy Policy. As a data subject in the European Economic Area, you have the right to access, rectify, erase, restrict, and port your personal data, as well as the right to object to certain processing activities. 9. Limitation of Liability
To the fullest extent permitted by applicable law, EbbiWriter shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including loss of data or loss of profits. Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable EU law.
10. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the European Union and the member state in which EbbiWriter is established, without regard to its conflict of law provisions. If you are a consumer resident in the EU, you also benefit from any mandatory provisions of the law of your country of residence. For disputes that cannot be resolved amicably, you may refer the matter to the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
11. Changes to These Terms
We may update these Terms of Service from time to time to reflect changes in law, our Service, or our business practices. We will notify you of material changes by email or by posting a prominent notice within the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
